These Terms & Conditions (“Agreement”) govern all sales, listings, transactions, and services provided by Fuji Automotive (“Company”, “we”, “us”, “our”). By engaging with us, placing a deposit, or purchasing a vehicle, you (“Customer”, “you”) agree to be bound by this Agreement.

All vehicle information, specifications, and prices are provided for general guidance only and are subject to change without notice. While we make reasonable efforts to ensure accuracy, errors, omissions, and outdated listings may occur. Vehicle availability is not guaranteed.

 

Prices shown may exclude registration, taxes, insurance, transport, and other applicable costs unless explicitly stated. Fuji Automotive accepts no liability for inaccuracies and reserves the right to correct errors at any time. Any corrections or updates apply prospectively and do not create liability for prior listings.

 

Customers must not rely solely on information contained on this website when making a purchasing decision and are responsible for confirming all details prior to entering into any agreement.

 

All sales are subject to our Terms & Conditions and Vehicle Condition Policy, which form the entire agreement between the parties and are confirmed at the point of sale.

1. COMPANY STRUCTURE & CONTRACTING PARTY

 

 

Fuji Automotive operates as a trading name and may conduct transactions under affiliated or partner entities including, but not limited to, Nipponz International and/or Cheap2Drive Limited.

 

The contracting party for each transaction will be confirmed on the invoice and/or sales documentation. The Customer agrees that obligations are owed only by the entity stated on the final invoice.

2. VEHICLE LISTINGS & AVAILABILITY

 

 

All vehicles advertised on our website, social media, or third-party platforms are:

 

• Subject to prior sale

• Subject to availability

• Not guaranteed to be in stock at the time of inquiry

 

 

We reserve the right to:

 

• Withdraw listings at any time

• Refuse sale at our discretion

• Substitute vehicles where applicable

3. PRICING & COSTS

 

 

All prices displayed are:

 

• Indicative only

• Subject to change without notice

• Based on information available at the time of listing

 

 

Unless explicitly stated in writing, prices do not include:

 

• Registration fees

• Road tax

• Insurance

• Transport or delivery fees

• Export, shipping, or import costs

• Inspection or compliance fees

 

 

A final confirmed price will be provided prior to payment.

4. ERRORS & OMISSIONS

 

 

While we aim to ensure accuracy, we do not guarantee that any listing, description, specification, or price is free from error.

 

We reserve the right to:

 

• Correct errors at any time (including after a deposit is placed)

• Cancel or amend transactions affected by errors

 

 

Corrections apply prospectively only and do not create liability for past inaccuracies.

5. DEPOSITS & PAYMENTS

 

 

• A deposit may be required to secure a vehicle

• Deposits are non-refundable unless otherwise agreed in writing

• Full payment must be completed within the agreed timeframe

 

 

Failure to complete payment may result in:

 

• Cancellation of the transaction

• Forfeiture of deposit

6. VEHICLE CONDITION & WARRANTY

 

 

All vehicles are sold:

 

• “As-is, where-is”

• Without any warranty, unless expressly provided in writing

 

We do not guarantee:

 

• Mechanical condition

• Future performance

• Suitability for a specific purpose

 

      Any descriptions or statements made:

 

• Are for guidance only

• Do not form part of a contractual guarantee

 

 

    Customers are responsible for conducting their own inspections where desired.

7. IMPORT / EXPORT & COMPLIANCE

 

 

Where vehicles are exported or sold for export:

 

• The Customer is solely responsible for ensuring compliance with destination country laws

• The Company makes no guarantee that a vehicle will meet import requirements

 

 

We are not liable for:

 

• Import refusal

• Additional taxes or duties

• Compliance modifications

8. THIRD-PARTY SERVICES

 

 

We may engage third-party providers (e.g. transport, shipping, inspections).

 

We are not liable for:

 

• Delays

• Damage

• Loss

• Pricing changes

 

          caused by third parties.

9. LIMITATION OF LIABILITY

 

 

To the maximum extent permitted by law, the Company shall not be liable for:

 

• Indirect or consequential losses

• Loss of income, profit, or opportunity

• Customer dissatisfaction relating to expectations

 

Total liability, if any, shall not exceed the amount paid to the Company for the vehicle.

10. CUSTOMER RESPONSIBILITY

 

 

The Customer acknowledges:

 

• They have reviewed all available information

• They are not relying solely on advertising or verbal statements

• They accept the inherent risks of purchasing a used vehicle

11. CANCELLATION

 

 

Once payment is made, cancellations are:

 

• Not permitted, or

• Subject to fees at the Company’s discretion

12. COMMUNICATIONS

 

 

All official confirmations must be in writing.

 

Verbal discussions, messages, or informal communication:

 

• Do not override this Agreement

• Are not legally binding unless confirmed in writing

13. DISPUTES

 

 

In the event of a dispute:

 

• Both parties agree to attempt resolution in good faith first

• Claims must be supported by documented evidence

14. GOVERNING LAW

 

 

This Agreement shall be governed by and interpreted in accordance with the laws of Japan.

15. ACCEPTANCE

 

 

By placing a deposit, making payment, or proceeding with a purchase, the Customer confirms:

 

• They have read and understood these Terms & Conditions

• They agree to be legally bound by them
